1. Service Provider:
SmallBisons services are provided and contracted with Keepwish Corporation, C.A., a company governed by the laws of the Bolivarian Republic of Venezuela, domiciled in Los Teques, Miranda, Venezuela, CP 1210, which is the owner, creator, developer, and designer of the website SmallBisons.com, hereinafter referred to as 'SmallBisons', 'we', 'us', 'our', 'website', or 'site.' Any person who accesses the SmallBisons website, creates a user account, makes top-ups for the purchase of subscriptions, capacity packages, and designed projects, or in general any action they perform within the site, will be referred to hereinafter as 'user', 'users', 'you', or 'the users.'
2. Eligibility:
Only those with the legal capacity to enter into a contract may enjoy our services. By registering (creating an account), you declare that you accept the terms and conditions of service contained herein, and you undertake to update your information when necessary. In order to ensure the security of the site, we may regularly or occasionally request additional information to verify your information. Accounts with incomplete information or without validating or executing violations within the terms described herein will be suspended and/or deleted. We may modify this agreement frequently, changing the services, their form, and functionality. Any user who disagrees with the modifications made to the website may request the cancellation of their account by sending a direct email to hola@smallbisons.com.
3. Services:
Through the SmallBisons website, we developed a service with a unique and innovative method that allows all registered users to enjoy a variety of engines for creating designs using reference models (templates provided by the service) or creating them from scratch. These designs can be used in jewelry, ornaments, knitting, and other crafts. Each design provides statistics on all the materials used, estimated measurements and weights, videos related to techniques, tutorials, and other details to consider when actually creating them. We offer a Supplies Store section so you can obtain all the materials and tools necessary to create your physical designs.
4. Registration and Login:
Anyone who wants to enjoy the service must fill out a form indicating their name, username, password, and email address, which must be validated to use the platform. They must also indicate the source from which they received the information on the website. To fully use the platform, you must validate your account using a code sent to your email. You can request a resend if it doesn't arrive. You can also use the option to request the code via WhatsApp. When you log in, you must use your username and password for your exclusive use.
5. Account Access:
Users will access their SmallBisons account using their username and personal security code, which they must keep completely confidential. They may also log in using social media. Users are responsible for all actions taken within their account, as access and use are strictly restricted by the security code. If we detect any unknown access or use of their account, they have the option to change their access credentials. Any additional information required can be requested by emailing hola@smallbisons.com, or by writing to the customer service team from their account. It is established that the sale, session, or transfer of the account, including its information, both projects and designs created or copied, is prohibited. Upon detection of any of these cases, we will immediately suspend the account and restrict access to those responsible for the violations.
6. Using the platform in free mode:
As long as the user uses the service for free, they will have limited access to all tools and sections within the platform. Among these, within the ildes engine, they can: Rename the project, select and adjust the size of materials, design, delete, mark columns, add columns to the left, add columns to the right, copy a column, delete a column, and cancel the enabled action. Additionally, they can change preferences within the bracelet with the options to select a single color or mirror colors. Additional options include previewing, obtaining detailed statistics for each color, and a button directly to Smallbisons' WhatsApp to order the materials in use. Within the Loom Engine, you'll have access to select the width and length range to create a base template to design on. You'll also have access to free typography, where you can edit it according to the aforementioned enabled tools.
Within the Peyote engine, you'll have access to select the width and length range, vertical or horizontal view, odd or even style, and start mode A or B. To obtain a base template to design on, you can: Rename, select material, design using the paint, fill, and erase options, rewind action, view the preview, get detailed statistics for each color, as well as a button directly to Smallbisons' WhatsApp to place an order for the materials in use. Within the Hama Beads engine, you will have access to select the width and length range to obtain a base template to design. The user is aware and understands that projects they begin designing in free mode will be automatically deleted after a period of 30 consecutive days. The only way to save them is by purchasing one of the subscription plans.
7. Using the Platform with a Subscription:
As long as the user uses the service with an active subscription, they will have unlimited access to all content purchased in the subscription package.
By purchasing any of the Design Tools subscription packages, they will have unlimited Premium access for the duration they have chosen.
Within the ildes engine, you can: Rename the project, select and adjust the size of materials, design, delete, mark columns, add columns to the left, add columns to the right, copy a column, delete a column, and cancel the enabled action. Additionally, you can change the preferences inside the bracelet with the options to select a single color or mirror colors. You can also set the automatic columns (this is because each time you replace the columns, they are activated as Manual because you are editing from the replacement), select the entire interior design to be Single Color and you can select which color; you can also use the mirror colors option, which will set the reference colors to the ones you are working with in the main design.
Additional options include previewing, using the guide, replacing materials, getting detailed statistics for each color, and a button directly to Smallbisons' WhatsApp to order those materials; measurements and weight (both approximate), exploring more designs, creating a new project, creating a copy of the project, selecting a theme for your desktop, downloading the image in .png format, and using the up and down menu.
You can also use the option to automatically generate a sign and edit with the aforementioned tools.
In the loom engine, the user will have access to select the width and length range to obtain a base template on which to design. They can: Change the name, select a material, design using the paint, stroke, fill, and erase options, backspace, view the preview, use the guide, and adjust their visual preferences. They can also get detailed statistics for each color, and a button directly to Smallbisons' WhatsApp to order the materials in use. Measurement and weight (both approximate), explore more designs, create a new project, create a copy of the project, select a theme for your desktop, download the image in .png format, and use the up and down menu.
You'll also have access to free and premium typography, where you can edit it according to the aforementioned enabled tools.

By choosing Premium subscription plans for Videos and Courses, you'll have access to step-by-step video tutorials of exclusive techniques for making the physical product. Likewise, you will have access to all step-by-step classes uploaded to the platform for the duration of your subscription.
Both subscriptions are cumulative and include personalized support whenever the user deems it necessary, during established business hours.
The user has the option to choose both subscription plans according to their preferred timeframe. Both will be governed by the terms mentioned in each plan.
8. General usage sections:
All projects created in the ilde engine have a limit of 100 columns by 25 rows. The loom engine has a limit of 100 columns by 100 rows. The peyote engine has a limit of 100 columns by 30 rows. The Hama beads engine has a limit of 60 columns by 60 rows.
About SBS, it is a virtual currency of the platform. Its function is to reward the user for using the platform. Users can claim 10 SBS daily upon logging in. They can also play in the SBS rain daily, which consists of collecting as many coins as possible within a 1-minute period. Another way to obtain them is when recharging; each SBS is equivalent to $0.01. SBS are only redeemable for flea market patrons.
Anyone who registers automatically acquires a capacity of 5 unique and non-transferable spaces, which can be used in both free and premium modes.
All users have access to the following sections within their Menu:
User Catalog, where they can see all the photos of users who have uploaded photos to their catalog.
My Account displays the username and associated email address. You have the option to change your email address by sending a direct message to the support WhatsApp to make the change. You can change your username by exchanging 500 SBS each time you need to change it.
My Catalog allows users to add information and photos as they see fit, so that by sharing their profile link, others can have a reference to their location and the products they sell.
My SBS shows the amount of SBS available. In addition to using the daily claim actions, you can participate in the daily SBS rain.
My Projects will show you how much total space you have available and how much you've used, as well as which projects you've been working on, including space from purchases, downloads, and project copies. If capacity is reached, the user can delete projects to free up space. Deleted projects are unrecoverable.
Pattern Marketplace: The user can access the marketplace whenever they want, download free patterns or purchase paid patterns using the available balance in their account, or exchange them for SBS available in their account.
Videos/Courses: As long as the user maintains a subscription to the Video/Course Plan, they will have access to all courses uploaded to the platform.
Recharge: The user can request a recharge for any amount they wish.
Orders placed: The user will see the history of recharges and subscriptions made, as well as discounts for pattern purchases at the marketplace.
Subscribe: The user can access and purchase any of the subscription plans they require, as many times as they deem appropriate, as long as they have available balance in their account.
Supplies Store: The user can add a shopping cart the quantities and materials available in the supply store. We are responsible for managing your order and ensuring it arrives at the delivery location you selected. In the case of requesting a shipment where a third party is involved (selected shipping agency), at the time of delivery of your package to their offices, we are completely excluded from responsibility for handling, delivery times, manipulation, loss, or misplacement. Whenever you select these shipping options, as a user you are responsible for it. When choosing the personal delivery option, whether you attend or send another person in your place, you must ensure at the time of receiving the package that everything is correct. Otherwise, you must immediately notify us through the internal chat of your order, where the assigned personnel will ensure that they provide you with options to correct the error. If, on the other hand, you receive the package without confirming that everything is correct as you requested, we are excluded from any claim, reward, misplacement, loss, or theft of your package.

Version and Updates: Users will be able to see updates made to the platform.

9. Fees, Purchases, and Billing:
To enjoy all the benefits of the platform, the user must top up their balance via bank transfer or national mobile payment (Banesco Banco Universal, C.A.) or through MoneyGram, AirTM, Zinli, or PayPal. This allows them to purchase subscription packages, purchase projects, and purchase capacity packages (project spaces).
Fees: Registration on SmallBisons is completely free, as is limited use of the service. To access all services, features, and tools, the user must purchase a subscription plan that best suits them. Upon logging in, the details of the benefits for each plan are provided in the Menu/Subscribe section.
Top-ups: The user must top up their balance using the linked bank accounts. The amount must be the exact amount indicated at the time of purchase. If it is less, the top-up activation will not be processed until the amount is reached. If the value is higher, the top-up will be activated and the additional amount will be reflected in your account balance.
Purchases: Once the balance is recharged, as long as there is a positive balance, the user can purchase the subscription plans, capacity packages, and projects they desire.
Billing: In the Orders Placed section, the user has access to all transactions such as top-ups, subscription purchases, capacity purchases, project purchases, and the available balance. Any actions used through active promotions will also be reflected.
SmallBisons reserves the right to modify, change, add, or remove the rates and amounts for current services and products at any time, which will be notified to users via the email address associated with their account. However, SmallBisons may temporarily modify the rates for its services due to promotions. These modifications will be effective when the promotion is made public or the announcement is made.
Regarding Project Purchases: The user, as long as they have a credit balance, can purchase as many projects as they want once per account. These projects will be available in the My Projects section. If they are deleted from this section, they can download them again in the Pattern Marketplace. All purchased projects are linked to the account, granting the user additional space. The user will have the option to report the project once purchased for various reasons, such as: a design different from the one shown in the image, design errors, editing tool issues, or any other issues that disrupt the design's functionality in the purchased project.
The user agrees that even if they purchase the project, they will only have unlimited access to the tools at the time they purchase a subscription plan. Purchasing the project in free mode will limit them to the free terms and editing tools.
10. Gifts and Promotions:
SmallBisons may offer gifts and promotions through social media, the website, or any other means. Users will be informed about the Promotion Codes, which will vary in their benefits, duration, and availability. The details of each promotion will provide information for each one.
11. Refunds:
Under no circumstances will refunds be issued if the user makes a payment greater than the amount indicated. Therefore, it is essential that the user confirms the exact amounts at the time of payment. If, on the other hand, the user makes an incomplete payment, they must complete the requested amount in order to proceed with the recharge. The user may cancel the subscription whenever they deem appropriate, keeping in mind that they will no longer receive refunds.
12. User Obligations and Responsibilities:
Users may use all services contained on SmallBisons in compliance with the current laws of the Bolivarian Republic of Venezuela. In this regard, the user agrees that any content that: violates the law, is harmful, unlawful, threatening, abusive, harassing, defamatory, contains adult content, prostitution, pornographic, pedophilia, gambling-related, defamatory, invades the privacy of others, or harms minors in any way; harasses, degrades, intimidates, or is hateful toward an individual or group of individuals based on their religion, gender, sexual orientation, race, ethnicity, age, or disability; impersonates another person or entity, including an employee, representative, or any member of SmallBisons; implies a false statement or in any way impersonates the User's relationship with a person or entity; is false, misleading, deceptive, deceptive, or deceives information; includes personal or identifying information about another person without that person's express consent; disrupts the normal flow of dialogue by posting an excessive amount of messages (a 'battery attack') to the service in any way negatively affecting users' ability to use the site; infringes any patent, trademark, trade secret, copyright or other proprietary right of any person, or content that you do not have a right to make available to the public under any law, contractual relationship, or inheritance; contains software viruses or other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment; advertises illegal services or the sale of items the sale of which is prohibited or restricted by applicable law, as applicable; uses misleading email addresses, or in any way utilizes the SmallBisons branding or forged headers or otherwise manipulates identifiers in order to disguise the origin of content transmitted through the website. 13. Sanctions and Suspension of Operations:
In cases where the system, moderators, and/or other officials detect suspicions or clear evidence of misuse, violations of national laws, the Terms, and/or SmallBisons policies in general by affiliated users, SmallBisons may warn, temporarily suspend, or permanently disable the account or information posted by users. In the event of a User's suspension or permanent disabling, their profile, as well as all information and projects they may have, will be removed from the site.
14. System or Database Violations:
Any actions or uses of devices, software, or other means intended to interfere with or cause damage to the website's operations, SmallBisons accounts, or databases are prohibited. Any attempted interference or infringing activity that violates intellectual property laws and/or the prohibitions stipulated in these Terms will subject the person responsible to appropriate legal action and the application of the penalties described in these Terms. The person responsible will also be liable for compensation for any damages caused.
15. Maintenance and System Failures:
Given that the SmallBisons website is based on software, hardware, and the Internet, eventualities may arise that interrupt access to and continued or uninterrupted use of the site due to unforeseen events or force majeure, as well as technical difficulties or Internet failures, or any other circumstance beyond SmallBisons' control. In such cases, efforts will be made to restore the site as quickly as possible without incurring any liability. Likewise, SmallBisons will not be liable for any errors or omissions contained on its website. Users may not incur any liability or demand payment for lost profits for damages resulting from technical difficulties or system or Internet failures. The user agrees that they are aware of this and will therefore take precautions to avoid inconveniences.
16. Site Responsibility:
SmallBisons only provides an online platform through its website, SmallBisons.com, offering the services contained in these terms.
It is expressly clarified that both SmallBisons and its representatives, moderators, and other team members are exempt from any liability for the data, information, projects, and copyrighted designs used by users on their behalf, and in general, for all actions the user performs with their account within SmallBisons. The sole responsible party is the user who created the account.
These Terms only govern user behavior within the SmallBisons website, as well as what we offer through our services, without creating any partnership, agency, franchise, or employment relationship between SmallBisons and users. We recommend acting with prudence and common sense. By creating an account, you declare that you accept all the Terms of Service contained herein, as well as the Privacy Policy, and that you agree to the Legal Notice.
17. Applicable Law and Jurisdiction:
In general, these legal conditions have been drafted in accordance with Venezuelan law, and are therefore subject to its law and jurisdiction. In the event of a conflict in the interpretation of these conditions, the competent law and jurisdiction shall be the Courts of the Bolivarian Republic of Venezuela.
18. Modification of the Terms of Service:
Necessary modifications may be made to these Terms of Service, as well as to the content and services provided on the website. As applicable, users will be informed of the modifications to be made via the email provided, as well as through notifications at the beginning of the session. Once the corresponding modifications are made, you will also be notified by the same means mentioned above.
